Privacy Policy The TOURING app privacy policy and procedures shall be governed by the Personal Data Protection Law and all the relevant laws applicable in the Kingdom of Saudi Arabia. The Saudi judiciary shall be competent in adjudicating in the lawsuits arising thereunder. Wherever the below terms appear herein, they shall have the meaning assigned to each, unless the context otherwise requires: The Law: The Personal Data Protection Law and the relevant laws applicable in the Kingdom of Saudi Arabia. The App: app that plays the role of mediator between the user and the service provider. Personal Data: It refers to every description- of whatever sources or form- that might lead to specifically recognizing the person or making directly or indirectly recognizing them possible, such as: the name, ID number, addresses, contact numbers, licenses, records and personal properties numbers, bank accounts and credit cards numbers, the individual’s still or motion images and other personal data. Processing: It refers to any process that is performed on personal data in any manual or automatic means, including: collecting, recording, archiving, indexing, arranging, coordinating, storing, modifying, updating, merging, retrieving, using, disclosing, transferring, publishing, sharing or interconnecting, withholding, deleting and destroying data. Collecting: It refers to the app obtaining personal data in accordance with the Personal Data Protection Law and the relevant laws, whether directly from its owner or from their representative, legal guardian or other party. Destroying: It refers to every action that leads to the removal of the personal data and renders it impossible to review or recover it again. Disclosing: It refers to allowing any person- other than TOURING app- to obtain, use or have access to the personal data in any means and for whatsoever purpose. Transferring: It refers to transferring personal data from one place to another to process it. Publishing: It refers to broadcasting or making available any of the personal data through printed, audio or visual means of publication. Sensitive Data: It refers to any personal description that includes a reference to the individual’s ethnical or tribal origin, or religious, ideological or political beliefs, or hints to his/her membership in any civil societies or organizations, in addition to the criminal and security data, identification biometrics data, genetic data, credit data, medical data, location data and the data that indicates that one or both parents of the individual are unknown. Owner of the Personal Data: It refers to the individual to whom the personal data is related or their representative or legal guardian. In accordance with the TOURING app privacy terms: The user who owns the personal data has the right to learn that TOURING app asks for permission to collect personal data, in order to provide the user with the best service. Registration on or use of TOURING app shall be deemed an express consent to share the following personal data: The name, ID number, addresses, contact numbers, licenses, records and personal properties numbers, and bank accounts and credit cards numbers. In addition to collecting your data when you connect the Application to Facebook, Instagram, or any other accounts linked to your TOURING app, all information from these accounts such as friends and contacts are used to improve your experience of using the app. This information helps us improve the quality of service ensured by TOURING app. And provided in an appropriate and interesting manner that suits your personal requirements, ultimately guaranteeing a unique experience. TOURING app. will not collect information without the user's permission unless these data are publicly available or collected from a publicly available source. TOURING app. uses high security standards to protect data and information, encrypting sensitive and all confidential data. Sensitive data includes every personal statement that includes a reference to an individual's ethnic or tribal origin, religious, intellectual, or political beliefs, or indicates membership in associations or civil institutions, as well as forensic and security data, biometric data identifying, genetic data, credit data, healthcare data, location data, and data that indicates that one or both of an individual's parents is unknown. The user has the right to view and obtain a copy of the data collected based upon his/her prior consent. TOURING app. has the right to determine the duration of the right to exercise access to the data of the user whenever necessary to protect the holder of the data or other potential harm. TOURING app. will not disclose the user's data except in the following cases and based on the user's consent: If the user's data was collected from a publicly available source. If the entity requesting disclosure is a public “government” authority, for security purposes, to implement another system, or to meet the judicial requirements. If the disclosure will be limited to the subsequent processing of the data in a way that does not lead to the identification of the data’s owner or any other individual in particular. The user has the right to submit a request to correct, finalize, or update the data available with TOURING app. TOURING app. destroys the user's collected data immediately after fulfilling the purpose of its collection; however, TOURING app may save such data in line with the controls stipulated in the Personal Data Protection Law. TOURING app. keeps the data even after the purpose of collecting it is completed in the following two cases: If there is a justified reason that necessitates keeping it for a specific period, in which case it shall be destroyed after the expiry of this period or the fulfillment of the purpose of keeping it, whichever is longer. If the personal data is closely related to a case under consideration before a judicial authority and keeping it is required for this purpose, in this case it shall be destroyed after completing the judicial procedures of the related case. If it turns out that the personal data collected is no longer necessary to achieve the purpose of its collection, TOURING app will stop collecting it, and what was previously collected will be destroyed immediately. TOURING app will not use the personal contacts - including postal and electronic mail - of the owner in order to send advertising or awareness materials, except in accordance with the following: Users' consent to send this material to them That the sender of the material provides a clear mechanism - as determined by the relevant regulations - that enables the recipient to express his/her desire to stop receiving such materials. The TOURING app processes personal data, with the exception of sensitive data, for marketing purposes, if it was collected directly from its owner and they agreed to that in accordance with the provisions of the system. This privacy and data protection policy applies to the TOURING app only. So, the user is required to read the privacy and data protection policies of other sites when visiting them through the TOURING app. TOURING app contains links of other websites and therefore the contents provided on these websites are not under the responsibility of the application. The user must be aware that they may be exposed to hacking or spying by third parties. TOURING app is not responsible for the consequences of downloading any content from the application without using anti-virus software that protects their device or data. TOURING app will not disclose personal data except in the following cases: If the owner of the personal data agrees to the disclosure in accordance with the provisions of the system. If the personal data was collected from a publicly available source. If the authority requesting disclosure is a public agency, for security purposes, to implement another system, or to fulfill judicial requirements in accordance with the provisions specified by the regulations. If the disclosure is necessary for protecting public health or safety or the life or health of an individual or individuals. If the disclosure is only for processing that will not reveal the identity of the owner or any other individual specifically. The regulations specify the controls and procedures related to this. The platform will keep personal data even after fulfilling the purpose of its collection in the following cases only: If there is a justification it must be kept for a specified period, in which case it must be destroyed after the end of this period or fulfilling the purpose of its collection, whichever is longer.
